CCPA Privacy Law Overview

The California Consumer Privacy Act of 2018 (CCPA) gives people more control over the information that businesses collect about them and secures new privacy rights for California residents, including:
  • The right to know about the personal information a business collects about them and how it is used and shared;
  • The right to delete personal information collected from them (with some exceptions);
  • The right to opt-out of the distribution of their personal information; and
  • The right to non-discrimination for exercising their CCPA rights.
Website updates for CCPA involve requirements such as privacy notices, opt-out links, and more.

Does CCPA Apply to My Business?

CCPA may apply to more businesses than you expect. Technically, it applies to for-profit businesses that do business in California and meet ANY of the following:
  • Have a gross annual revenue of over $25 million, or
  • Buy, receive, share, or sell the personal information of 50,000 or more California residents, households, or devices; or
  • Derive 50% or more of their annual revenue from sharing California residents’ personal information.
The CCPA definition of personal information is broad. It includes offline data like addresses from mail lists and online data like IP addresses from website visits, so marketing activities alone may make CCPA applicable to many businesses.
